Terms & Conditions
1. The Subscriber shall comply with all applicable local, state, federal, and international laws, status, rules and regulations relating to the Subscriber’s use of the Services. The Subscriber shall not interfere with or disrupt networks connected or violate the regulation, polices or procedures of such network, or attempt to gain unauthorized access to the services, other accounts, computer systems or networks connected to the Services, through password mining or any other means.
2. The Subscriber acknowledges that Last mile switch namely Optical Network Terminal,ONU, Router, Wi-Fi Routers, SET TOP BOX, ANDROID BOX, IPTV BOX, FIBER OPTIC CABLES and such other network connectivity
equipment’s (“Subscriber Premises Network Equipment/CPNE”) installed at the Subscriber premises is a network equipment of RAHUL CABLE TV AND BROADBAND NETWORK used for the purposes of providing Internet broadband services to the Subscriber.
3. The Subscriber further agrees that the CPNE installed at his / her premises are not part of the Service package and are highly capital intensive in nature. The CPNE shall always remain the sole andexclusive property of RAHUL CABLE TV AND BROADBAND NETWORK and the subscriber shall not handle or tamper with the same. In case of discontinuation or termination of Services due to any reasons whatsoever, the Subscriber shall duly return the CPNE to RAHUL CABLE TV AND BROADBAND NETWORK in a reasonable and proper working condition to the satisfaction RAHUL CABLE TV AND BROADBAND NETWORK.
4. The Subscriber shall provide valid proof of address and proof of identity as per the direction issued by DOT from time to time to subscribe the RAHUL CABLE TV AND BROADBAND NETWORK services and as and when required by RAHUL CABLE TV AND BROADBAND NETWORK.
5. The Subscriber shall be required to obtain the fronthaul equipment required for providing the Services, from us. The Subscriber shall responsible for arranging as its own expenses all telecommunication equipment (including, computer, television, LAN card, operating system compatible with Services, media converter box, any software.
6. The Subscriber shall desist from sending from sending unsolicited messaging via the Service Broadband shall be entitled to disconnect the Service or block the service or block the Service for any duration it may recipient of such unsolicited message from the Subscriber.
7. The Subscriber shall ensure that unlawful, harmful, offensive, threatening, abusive ,harassing, defamatory, vulgar, obscene, libelous, invasive of another privacy, hateful, or of menacing, or which is offensive on moral, religious, communal or political grounds, or racially, ethnically or otherwise objectionable messages or communications, which are inconsistent with are inconsistent with the established laws of India, are not made, created, accessed, download, modified, transmitted or transmitted by him or any other person on the web server or web space or the Subscriber.
8. The Subscriber shall not tamper in any way with the software or the functionally of the Services. Without limiting the foregoing, the Subscriber shall not upload, post email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to damage interfere with, interrupt, destroy or limit the functionally of any computer software or hardware or telecommunications equipment or intercept or expropriate any system, data or information.
9. While every effort is made by us to provide highest quality Services, the Subscriber acknowledges that the linking, quality and speed of data transmission of the subscriber Broadband network is entirely dependent on various agencies such as the satellite provider, international gateway provider and various government and local authorities.
10. We shall in no event be responsible to the Subscriber in any manner what so ever for any failure, defect, error, malfunction, compatibility problems, delay in connectivity, systems breakdowns or accidental loss of connectivity of the Subscriber with Broadband network computers of the deficiency in data transmission between the Subscriber and Broadband Network computers, or for any inconvenience, damage or loss that may be caused to any one or of any kind arising therefrom.
11.The subscriber agrees no to invade another subscriber’s privacy. This includes, but is not limited to, the breach or attempt breach of the security of another subscriber’s computer, software or data without the knowledge and express consent of such subscriber. Use or distribution of tools designed for compromising privacy or security is security is strictly prohibited. 14. The subscriber shall strictly comply with the provision of the Indian Telegraph Act,
1885, and the Indian Telegraph Rule made thereunder and any amendments or replacement made there to from time to time.
12. The subscriber undertakes not to use the services. i)for any purposes of programme that is against the public interest, public order or national harmony or offends decency. ii)in breach of any laws, regulations, guidelines, instruction, etc. in whatsoever from that the Government of India may issue from time-to-time relating to the Services or otherwise. iii)to copy, upload, post, publish, transmit, reproduce, or distribute in any way or manner, whatsoever, information, software, or other material which is protected by a copyright or other proprietary right or derivative works with respect thereto, without obtaining permissions of the copyright owner or rightsholder. iv)to gain access to any computer system connected to internet without authorisation by the owner of the computer system. v)to access information or resources which are private to individuals and organisations unless permission to do so has been granted by owners or holders of the rights to such resources and information. vi) or otherwise in a manner which constitutes a violation or infringement of the rights of any person, firm or company (including but not limited to rights of copyrights of copyright or confidentially) or a violation or infringement of any statutory duty or obligation or any duty or obligation in contract, tort or otherwise, to any third-party.
13. The Subscriber agrees to defend, indemnity, and hold harmless Broadband its officers, directors, employees and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from the Subscriber’s use of the Service or the breach of these Terms of Service by the Subscriber, Broadband shall promptly notify Subscriber of any such claim, suit or proceeding.
14. The Subscriber understands further that the internet contains unedited materials some of which are sexually explicit or any be offensive to some people and accessing, download, creating, storing control over and accepts no responsibility whatsoever for such materials.
15. These Terms of Service shall be governed by and construed in accordance with the laws as applicable in India.
16. The Android Box along with its accessories (Remote, Audio Video Cable, HDMI CABLE & Adapter) has to be returned in working condition once the subscriber discontinues from the existing Android box plans. Incase of default, the subscriber has to pay the cost of the Android Box as per its present value.
17. Incoming and outgoing Local & STD call will be done through the available DID. The Landline number provided by Us are not permanent, the landline numbers are totally dependent on availability and it can be changed by the provider without any information given to the Subscriber.
18. Connection charges or Installation Charges are non-refundable.
19. If Subscriber doesn’t want to use our Service for a temporary period, then they have to return the STB or Any
devices installed at their premises to us and when they want to resume the services again, they have to notify us and we will again install the devices.
20.Subscription Packages rates are totally controlled by MSO or ISP, Subscribers have to accept the changes and pay according to the new monthly package rates fixed by the MSO or ISP.
21. If any subscriber wants to discontinue or terminate our Cable TV, Broadband Internet, Landline or any other services provided to them by us then they must return the equipment’s and devices installed in their premises by us.
22. If any subscriber refuses to handover our equipment’s and devices when the services are discontinued or terminated then we can take legal actions against them.
23. If the Subscriber doesn’t use our services for 02 (Two) months then they have to return or handover the CPNE devices and equipment’s installed at their premises to us, failing so will attract penalties or fines or legal actions against the Subscriber.
24. We at times Upgrade existing CPNE Devices or Equipment’s which was installed at Subscribers premises by us for a minimum upgrade charge.
25. As the services we provide are all in Prepaid system so the subscriber has to pay before the due date to avoid interruption in the services.
26. If the CPNE devices or equipment installed at Subscriber premises for using our services are found not working or physically damaged then the Subscriber has to pay the actual cost of the devices or equipment’s.
27. If due to any problem our working devices get faulty at Subscriber premises, then the Subscriber has to pay the repairing charges if the device is out of warranty. We provide 1 year Warranty on the devices and equipment’s installed at Subscribers premises from the date of Installation.
28. If for any major climate issues or pandemic or because of some big problems our services interrupt
then the Subscriber has to bear with us and understand the situation and cannot claim us for the same. Any normal service-related issues or complaints will be entertained within 48 hours.
29. If any Subscriber relocates to any place within our service area, we will provide free installation to the new location, if the location doesn’t fall in our service area, then the subscriber must pay the outstanding bills and return the devices and equipment to us immediately.
30. Free Installation Scheme Subscribers have to use our services for minimum 2 years, if they want to terminated the services then they have to return the devices and equipment’s installed by us and has to pay a penalty amount of Rs.2000/- (Rupees Two Thousand Only).
